Terms of Service

Key points: JAKUU is analysis, not financial advice. Prediction markets involve real financial risk. You are responsible for your own trading decisions. Pro subscriptions are billed monthly or annually and can be cancelled any time.

1. Acceptance of Terms

By accessing or using JAKUU [寂空] at www.jakuu.ai or app.jakuu.ai, you agree to be bound by these Terms of Service. If you do not agree, do not use JAKUU. These Terms are governed by the laws of the State of Delaware, USA.

2. Description of Service

JAKUU is an AI-powered prediction market intelligence platform. We publish analysis, signals, and commentary on prediction markets — primarily Polymarket. Our content includes Black Swan alerts (contrarian market calls), Smart Money wallet tracking, and weekly market digests.

JAKUU is not a broker, investment adviser, or financial institution. Nothing on JAKUU constitutes financial advice, investment advice, trading advice, or any other form of regulated advice. See our Disclaimer for full risk disclosure.

3. Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately at support@jakuu.ai of any unauthorised use.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraud, or abuse the platform.

4. Subscriptions & Billing

Free tier: Available to all registered users at no cost. Access to signal titles, summaries, JAKUU calls, and the public track record.

Pro — Monthly: $19.00 USD per month, billed monthly. Renews automatically until cancelled.

Pro — Yearly: $190.00 USD per year, billed annually. Renews automatically until cancelled.

Payment: Credit/debit card payments are processed by Stripe. By subscribing, you authorise recurring charges to your payment method.

Cancellation: You may cancel your Pro subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will not receive a prorated refund for unused time in the current period.

Refunds: We do not offer refunds except where required by applicable law. If you believe a charge was made in error, contact support@jakuu.ai within 14 days.

Price changes: We may change subscription prices with 30 days advance notice to your registered email address. Continued use after a price change constitutes acceptance of the new price.

5. Acceptable Use

You agree not to:

  • Scrape, crawl, or systematically extract content from JAKUU without written permission
  • Resell, redistribute, or republish JAKUU signals or analysis without attribution and our written consent
  • Use JAKUU to manipulate prediction markets or engage in any market abuse
  • Attempt to circumvent account restrictions or access tiers you have not paid for
  • Reverse engineer, decompile, or attempt to extract the source code of JAKUU
  • Use JAKUU in any way that violates applicable law

6. Intellectual Property

All content on JAKUU — including signal analysis, AI-generated commentary, design, branding, and the JAKUU name and logo — is the property of JAKUU and protected by copyright law.

You may quote brief excerpts (under 50 words) of JAKUU analysis with clear attribution to jakuu.ai and a link to the original. Any broader reproduction requires written permission.

Market data displayed on JAKUU (prices, volumes, market questions) is sourced from Polymarket and subject to Polymarket's terms.

7. Service Availability

JAKUU operates on a best-efforts basis. We do not guarantee any specific level of uptime, availability, or performance. There is no Service Level Agreement (SLA) associated with any subscription tier, including Pro.

The service may be interrupted due to scheduled maintenance, emergency maintenance, Cloudflare infrastructure events, third-party API outages (including Polymarket), or any other cause within or outside our control. We will endeavour to minimise disruption but accept no liability for any interruption, degradation, or unavailability of the service, however caused.

Browser compatibility: JAKUU has been developed and tested using Google Chrome. While we make reasonable efforts to support modern browsers, we do not guarantee full compatibility with other browsers, browser versions, browser extensions, or custom browser configurations. If you experience issues, we recommend using the latest version of Google Chrome.

User connectivity: The performance and availability of JAKUU as experienced by you may be affected by factors entirely outside our control, including your internet service provider, network conditions, VPN software, firewall settings, and the performance of your device. We accept no responsibility for degraded performance or inability to access the service attributable to your connectivity or local environment.

8. Disclaimers & Limitation of Liability

JAKUU IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) ANY SIGNAL, ANALYSIS, OR AI-GENERATED CONTENT IS ACCURATE, COMPLETE, OR RELIABLE; (C) ANY DEFECT WILL BE CORRECTED; OR (D) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

No SLA, no guaranteed uptime, no guaranteed response time. Subscription fees are charged in exchange for access to the service as described — not as a guarantee of any particular availability, performance standard, or outcome. Service interruptions, however prolonged, do not constitute a breach of these Terms and do not entitle you to a refund except as expressly provided in Section 4.

Limitation of liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JAKUU'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICE, OR YOUR USE THEREOF — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY — IS LIMITED TO THE GREATER OF: (A) THE AMOUNTS YOU PAID TO JAKUU IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

IN NO EVENT SHALL JAKUU BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION: LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, TRADING LOSSES, COST OF SUBSTITUTE SERVICES, OR DAMAGES ARISING FROM SERVICE INTERRUPTIONS — EVEN IF JAKUU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify and hold JAKUU harmless from any claims, losses, or damages arising from your use of the service, your violation of these Terms, or your trading decisions made in reliance on JAKUU content.

10. Termination

We may suspend or terminate your access at any time for violation of these Terms. Upon termination, your right to access JAKUU ceases immediately. Provisions that by their nature should survive termination (Disclaimers, IP, Indemnification, Governing Law) shall survive.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute arising from these Terms or your use of JAKUU shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in Delaware, except that either party may seek injunctive or other equitable relief in court for intellectual property infringement or misappropriation.

Class action waiver: YOU AND JAKUU AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. If this waiver is found unenforceable, the arbitration clause shall be null and void in its entirety.

12. Force Majeure

JAKUU shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, civil unrest, government action or regulation, or any other event beyond our reasonable control.

JAKUU is also not liable for failures caused by the unavailability, degradation, or termination of any third-party service that JAKUU depends upon, including but not limited to:

  • Cloudflare — hosting, Workers, D1 database, KV cache
  • Anthropic — Claude AI API powering signals and the chat widget
  • Hugging Face — FLUX image generation API
  • Polymarket — Gamma, CLOB, and Data APIs providing all market data
  • Polygon / Polygonscan / Etherscan — blockchain data for Smart Money analysis
  • Coinbase — price feed API
  • Yahoo Finance / ForexFactory / CFTC — market and economic data feeds
  • Reuters / BBC / AP / Google News — news RSS feeds
  • Stripe — payment processing
  • Resend — transactional email delivery
  • Telegram — channel signal delivery
  • X (Twitter) — social publishing API
  • Whereby — video room functionality

In the event any upstream service becomes unavailable, JAKUU features dependent on that service may be suspended or degraded without notice and without liability to you. Such disruptions do not constitute a breach of these Terms and do not entitle you to a refund.

13. Right to Modify or Discontinue the Service

JAKUU reserves the right, at any time and without prior notice or liability, to:

  • Modify, suspend, or discontinue any feature, functionality, or content of the service
  • Change, restrict, or remove features available on the free tier
  • Alter signal formats, delivery methods, or publication schedules
  • Shut down the service entirely

We will make reasonable efforts to communicate significant changes in advance, but we are under no obligation to do so for free-tier features. Continued use of the service following any modification constitutes acceptance of the change. If you are a paying Pro subscriber and we discontinue the service entirely, we will provide a prorated refund for any unused prepaid subscription period.

14. Third-Party Services & Dependencies

JAKUU integrates with and is dependent upon a number of third-party services. Your use of JAKUU constitutes acknowledgment that these services form part of the platform and that JAKUU has no control over their availability, accuracy, terms, or conduct.

Key third-party services include: Cloudflare (infrastructure), Anthropic (Claude AI), Hugging Face (FLUX image generation), Polymarket (all market data), Polygon / Polygonscan / Etherscan (blockchain data), Coinbase (price feeds), Yahoo Finance / ForexFactory / CFTC (market and economic data), Reuters / BBC / AP / Google News (news feeds), Stripe (payments), Resend (email), Telegram (channel delivery), X/Twitter (social publishing), Microsoft Clarity (analytics), and Whereby (video).

JAKUU does not endorse, control, or accept responsibility for the content, practices, accuracy, or availability of any third-party service. Your use of linked or integrated third-party services is governed by their own terms and policies. We are not liable for any loss or damage arising from your use of or reliance on any third-party service, or from any third-party service's failure, inaccuracy, or change in terms.

In particular: all market data originates from Polymarket and is subject to their terms. All AI analysis is generated by Anthropic's Claude and is subject to Anthropic's usage policies. JAKUU cannot guarantee the continued availability of either service.

15. Severability & Entire Agreement

Severability: If any provision of these Terms is found by a court or arbitrator to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

Entire agreement: These Terms, together with our Privacy Policy, Disclaimer, and Cookie Policy, constitute the entire agreement between you and JAKUU with respect to the service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral.

No waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

16. Changes to Terms

We may update these Terms. Material changes will be communicated via email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
